Eron Cannon and Caitlyn Spencer obtained a unanimous defense verdict on behalf of a medical oncologist and a physician assistant in Pierce County Superior Court. The case involved allegations that the defendants were negligent in failing to discuss a rare genetic inability to metabolize an oral chemotherapy medication and failed to offer genetic screening prior to starting the patient on his chemotherapy regimen, which the plaintiff claimed caused the patient’s death. Plaintiff further claimed that the defendants failed to provide proper education to the patient about the risks and potential toxicities of the chemotherapy, and they asked the jury to award millions of dollars. The defendants denied the plaintiff’s claims and contended the care provided to the patient complied with the standard of care. The jury returned a unanimous defense verdict, finding that the healthcare providers met the standard of care.
